Vader en zoon Buslik: van Katanga naar de Bende van Nijvel

Van vader Max Buslik naar zoon Jean-François Buslik loopt, gespreid over een periode van twintig jaar, een rechte lijn. De vader organiseerde begin jaren zestig een trafiek van gevechtsvliegtuigen naar Katanga, wellicht in opdracht van de CIA, zo ontdekte Apache.be. De zoon was in de jaren tachtig actief in de bende van Bouhouche en Beijer, mogelijk eveneens in opdracht van de Amerikaanse geheime dienst.

Politieman Victor Van Humskerke snapte er niets van. Op 1 mei 1962 was er op de luchthaven van Deurne een Harvard (North American T-6 Texan) geland, een gevechtsvliegtuig dat normaal nooit op de luchthaven te zien was. Verdacht, vond hij, temeer omdat het toestel geen militaire kentekens droeg. Een dag later arriveerden er nog twee Harvards. En weer een dag later nog eens zes. Toen de politieman een kijkje ging nemen naast hangar A, waar de toestellen op een rijtje geparkeerd stonden, telde hij tien stuks. Eentje was blijkbaar ongemerkt gearriveerd. (1)

“De toestellen zijn kortelings in het zilver geschilderd”, noteerde de politieman. En verder:

De immatriculatienummers zijn nog vers en grofweg aangebracht. Op de romp is nog een overschilderde driekleurige cocarde merkbaar. Ik vermoed dat deze toestellen origineel aan de Belgische luchtmacht hebben behoord. Ze werden nog door de luchtmacht gebruikt bij de moeilijkheden in Congo. Deze toestellen zijn tweepersoons gevechtsvliegtuigen. Bij de luchtmacht waren ze bewapend met machinegeweren en raketten. Ze worden ook bij de luchtmacht gebruikt als schoolvliegtuig, als overgang van schroefvliegtuig naar straaljager. Het vliegtuig is zeer wendbaar en luchtvast, maar heeft in verhouding tot zijn zware motor een betrekkelijk lage snelheid. Het leent zich uitstekend voor scheervluchten over de grond. Ik heb vastgesteld dat er geen bewapening meer zichtbaar was. De openingen voor de monden van de machinegeweren in de voorliggers van de vleugels waren slechts met toile overplakt.

Katanga

Van Humskerke ging op onderzoek. Hij ontdekte dat de vliegtuigen inderdaad van de Belgische luchtmacht afkomstig waren, dat ze een omweg hadden gemaakt langs het Zwitserse Genève en de luchthaven van Oostende, en dat ze nu eigendom waren van de Compagnie Générale d’Exploitation Aéronautique (Cogea) in Brussel. Informanten vertelden hem dat de toestellen naar Deurne waren gevlogen om hier gedemonteerd te worden en vervolgens via de Antwerpse haven zouden worden verscheept naar Katanga. Kort na de onafhankelijkheid van het vroegere Belgisch Congo in 1960 had de koperrijke provincie Katanga zich onder leiding van Moïse Tshombe afgescheurd. Geen enkel land erkende de secessie, maar Tshombe kon rekenen op financiële steun van de Union Minière du Haut-Katanga en op discrete steun van de Belgische regering. De Katangese gendarmes, het legertje van Tshombe, vocht samen met een allegaartje van huurlingen in 1962 tegen de troepen van de centrale regering én tegen de blauwhelmen van de Verenigde Naties.

“Er worden momenteel pogingen gedaan om vliegtuigen over te brengen naar Katanga”, schreef Van Humskerke in zijn proces-verbaal. “Deze pogingen worden gedaan door Aviaton Benelux, waarvan de zetel gevestigd is op de Place Wéry in Brussel.”

Dit bleek de firma te zijn van Max Buslik en zijn echtgenote Thérèse Moncarey. Veel was er op dat moment niet bekend over het echtpaar. “De vrouw zou vroeger reeds betrokken geweest zijn in een zaak van diamantsmokkel”, wist de politieman.

Beide personen baten eveneens in Brussel een garage uit. Ze hebben op de luchthaven van Deurne twee halfzware, tweemotorige transporttoestellen staan. Er zou op een gelegenheid gewacht worden om de toestellen naar Katanga over te vliegen. Er zouden reeds twee toestellen zijn overgevlogen naar Afrika. Ook zouden er Spitfires, die door de luchtmacht verkocht werden, verdwenen zijn. Er is samenwerking geweest tussen Cogea an Aviation Benelux, maar er is een meningsverschil ontstaan over het bezit van vliegtuigmotoren en voor het ogenblik is er tussen beiden een vete.

Cogea, zo vernam de politieman nog, had de Harvards gekocht voor 40.000 frank (1.000 euro) per stuk en kon ze verkopen aan Katanga voor het tiendubbele: 400.000 frank (10.000 euro) per stuk.

Kolonel Brown

In de loop van de maand mei, 1962 volgde de gerechtelijke politie het traject van de ‘verdachte’ vliegtuigen op de voet. Eerst werden de Harvards overgebracht naar de ateliers van de firma B.K.S.I. in de Gashuishoevestraat in Merksem. Daar werden ze gedemonteerd en klaargemaakt voor verzending. Elk gedemonteerd vliegtuig werd verpakt in een kist, die 3.500 kg woog. “Er is in iedere kist een zeer kleine opening, met een schuifdeurtje, om de douane toe te laten vast te stellen dat er zich in iedere kist een vliegtuig bevindt”, noteerde de politie. Daarna werden de kisten door de Ruysnatie naar kaai nummer 26 in de Antwerpse haven getransporteerd. Tenslotte, op 6 juni 1962, werden de tien kisten onder het goedkeurend oog van de douane aan boord van het Portugese stoomschip Sao Silverio geladen. Het schip vertrok met bestemming Lissabon, de hoofdstad van het destijds door de fascistische dictator Salazar geregeerde Portugal.

“Er worden momenteel pogingen gedaan om vliegtuigen over te brengen naar Katanga”, schreef Van Humskerke in zijn proces-verbaal.

Wellicht gingen de tien gevechtsvliegtuigen vervolgens naar de toenmalige Portugese kolonie Angola, een buurland van Katanga, waar ze opnieuw in elkaar werden gezet. Het vervolg staat te lezen in een geschiedenis van de Avikat (Aviation Katangaise), zoals de Katangese luchtmacht werd genoemd:

Rond het midden van september 1962 zijn een half dozijn T-6′s geland in Kolwezi, het eerste deel van een serie van tien toestellen die besteld werden bij Cogea in Oostende. Normaal bestemd om te dienen als antiguerilla-vliegtuigen, werden ze door de Portugezen aan Katanga geleverd zonder bewapening. Van zodra ze aankwamen in Katanga, werden ze voorzien van mobiele systemen voor bommen van 50 kilo. Samen met de vliegtuigen arriveerde een ploeg van een tiental piloten en een aantal Poolse mechaniciens, die gerecruteerd waren door ‘kolonel’ Jean Zumbach. (2)

Diezelfde Jean Zumbach was eerder ook gesignaleerd op de luchthaven van Deurne. Op 3 mei 1962, de dag waarop er zes Harvards in Deurne zouden landden, arriveerde de ‘kolonel’ aan de stuurknuppel van een klein personentransporttoestel van het type De Havilland Dove. “Dit vliegtuig kwam vier piloten opladen om hen naar Genève te brengen”, wist de politie, “waar ze elk een Harvard moesten gaan halen om het toestel naar Deurne over te vliegen.” Zumbach, die zich ook ‘Colonel Johnny Brown’ liet noemen was een Poolse piloot die tijdens de Tweede Wereldoorlog had gediend in de Britse Royal Air Force. Hij was in 1962 door Tshombe ingehuurd om de Katangese luchtmacht uit te bouwen. (Vijf jaar later, in 1967, deed Zumbach precies hetzelfde voor de opstandige provincie Biafra in Nigeria, GT.)

Stock américain

Pas vele decennia later raakten meer details bekend over Max Buslik. Hij was een Duitser, geboren in 1919 in Leipzig en van beroep horlogemaker. Zijn echtgenote, de française Thérèse Moncarey, was pilote. Beiden hadden op het einde van de Tweede Wereldoorlog vermoedelijk samengewerkt met de OSS, de voorloper van de Amerikaanse geheime dienst CIA. Na de oorlog woonde het echtpaar enkele jaren in New York, waar in 1952 hun zoon Jean-François werd geboren. Het gezin vestigde zich vervolgens in Brussel. Vader Buslik begon er een garage op de Place Verte in Sint-Joost-ten-Node. In 1959 volgde de oprichting van Aviation Benelux, de chartermaatschappij die gevechtsvliegtuigen leverde aan Katanga. Begin jaren zestig opende Max Buslik de Surplus 13, een stock américain waar afgedankte legerspullen werden verkocht, in de Verbiststraat in Sint-Joost-ten-Node.

Toen vader Buslik in de jaren zeventig verlamd raakte als gevolg van een beroerte, werd zoon Jean-François zaakvoerder van Aviation Benelux en van de Surplus 13-winkel. “De Surplus 13 was bijzonder populair bij de klasgenoten van Jean-François uit het plaatselijk atheneum, die er in de zomer vakantiejobs kregen”, schreef Humo. Een van die schoolvriendjes was Madani Bouhouche, “die gefascineerd was door de wereld die voor hem openging bij de familie Buslik: een pakhuis vol met legerrommel, combat boots, dolken, hopen geld, vakanties in Club Med, en geheime agenten die in en uit liepen.” (3)

Buslik, die electronica had gestudeerd aan de ULB en een opleiding als piloot had gekregen bij Abelag Aviaton, fungeerde in de bende van Bouhouche als technicus en klusjesman

Via de Busliks kwam Bouhouche ook in contact met Frank Eaton, een Amerikaanse agent van de DEA die in die tijd op de Amerikaanse ambassade in Brussel werkte en bekend stond als een vertrouwensman van de CIA.

Madani ‘Dany’ Bouhouche, zijn kompaan Robert ‘Bob’ Beijer, Martial Lekeu en een reeks anderen werden later beroemd en berucht. Als gestuurd door een onzichtbare hand gingen ze begin jaren zeventig bij de rijkswacht, eerst bij de drugsectie, later bij de infosectie van de Brusselse BOB. Daar maakten ze niet zozeer jacht op boeven, maar ontpopten ze zichzelf tot criminelen en terroristen. Vaak werden ze als speurders ingezet op misdaden die ze zelf hadden gepleegd of waar ze iets mee te maken hadden, zodat ze ideaal geplaatst waren om het onderzoek in de war te sturen. Ook nadat ze uit de rijkswacht werden gezet, bleven ze onder het mom van privédetective betrokken bij talloze (grotendeels nooit opgeloste) criminele activiteiten, vaak gelinkt met de misdaden van de Bende van Nijvel.

Kaiserslautern

Buslik, die electronica had gestudeerd aan de ULB en een opleiding als piloot had gekregen bij Abelag Aviaton, fungeerde in de bende van Bouhouche als technicus en klusjesman. Hij knutselde bijvoorbeeld het ontstekingsmechanisme van de bom in elkaar waarmee in 1981 een dienstauto van de BOB werd opgeblazen. Hij werd hiervoor een eerste keer aangehouden. Gerald Damseaux, een agent van de Staatsveiligheid die bevriend was met Buslik, had hem geholpen bij het maken van de bom. “Toen de moeder van Buslik me kwam vragen om tussen te komen toen haar zoon opgepakt was, heb ik alles verteld aan mijn oversten”, vertelde Damseaux later. “Ik werd aangeraden niets te zeggen.” (4)

Na drie maanden voorarrest werd Buslik voorwaardelijk vrijgelaten in februari 1982. In oktober van dat jaar volgde de roemruchte overval op de luchthaven van Zaventem, waarbij Sabena-veiligheidsagent Francis Zwarts werd vermoord. De daders waren volgens het parket Bouchouche, Beijer en Buslik. Volgens een Amerikaanse krant reed Buslik meteen na de overval naar de Amerikaanse basis in het Duitse Kaiserlautern, om er als vrijwilliger dienst te nemen in het Amerikaanse leger. “Could there be a better place to hide?”, vroeg de krant zich af. Na een jaar dienst, onder meer in Fort Jackson, het opleidingscentrum van het Amerikaanse leger in Zuid Carolina, kwam hij terug naar België. (5) Buslik zelf beweerde dat hij niet aan de overval kon hebben deelgenomen, omdat hij op dat moment in het Amerikaanse leger zat. (6)

Na een tweede aanhouding, opnieuw voor de bomaanslag in 1981, nam Buslik de benen en vestigde zich in North Palm Beach in Florida.

Hij vond er werk als vlieginstructeur bij Kemper Aviation op de luchthaven van Lanthana. Buslik werd in februari 1995 door het assisenhof van Brabant bij verstek veroordeeld tot de doodstraf voor zijn aandeel in de roofmoord op Zwarts. Maar vreemd genoeg werd hij na dit vonnis niet internationaal geseind en deed het Belgische gerecht geen enkele moeite om zijn uitlevering te vragen. Pas eind 1996 kwam er een internationaal aanhoudingsbevel. Buslik veranderde prompt zijn naam. Hij was ondertussen in Florida getrouwd met Diane Somerville en liet zich voortaan Jean-François Somerville noemen.

Nog eens drie jaar later schoot het gerecht eindelijk in actie, nadat het weekblad Humo het adres van Buslik gewoon op het internet had gevonden. Op een ochtend in april 1999 werd hij op vraag van de Belgische justitie door de Amerikaanse politie opgepakt, toen hij in short en op sandalen uit zijn woning aan het strand stapte. Meer dan een jaar later werd hij door de VS uitgeleverd aan ons land.

Zijn proces volgde in oktober 2001, op beschuldiging van roofmoord, heling van gestolen goederen, bomaanslag en beziet van explosieven. Buslik werd vrijgesproken over de hele lijn en mocht van de rechtbankvoorzitter “in alle sereniteit terugkeren naar zijn echtgenote in de VS”.

Toevallig gevonden? Kemper Aviation is niet zomaar een bedrijfje.

Sterker nog: Joe Kemper, de bedrijfsleider van Kemper Aviation, kwam in oktober 2001 speciaal naar Brussel om te getuigen op het assisenproces tegen Buslik. Hij had niets dan lof voor de beklaagde en noemde Buslik “een van de beste pilootinstructeurs die hij ooit heeft ontmoet”. Uitgerekend op dezelfde dag van zijn getuigenis bezochten agenten van het FBI opnieuw Kemper Aviation in Florida, omdat Mohamed Atta en Marwan El-Shehhi bij het bedrijf een pilotenopleiding hadden gevolgd.

Het is intellectueel een zeer aantrekkelijke piste, de Bende van Nijvel en de CIA, maar daar blijft het dan ook bij, want bewijzen… Dat was de boodschap van wijlen René Haquin, die als gerechtelijk verslaggever voor Le Soir de hele affaire van zeer nabij heeft gevolgd, in één van zijn bijdragen aan het boek ‘Les grands dossiers criminels en Belgique’ (Editions Racine, 2005).
Deze ‘ CIA-piste’ werd nadien dubbeldik in de verf gezet door Guy Bouten in ‘De Bende van Nijvel en de CIA’ (Uitgeverij Van Halewych, 2011). In een bespreking van dat bundeltje gedrukt papier op http://www.dewereldmorgen.be schreef ik naar aanleiding van de passage, waarin ‘gonzo-journalist’ Bouten verslag uitbracht over zijn ontmoeting met ene Willy V.: “Willy is blij dat hij me van dienst kan zijn, want uitgerekend vorige maand heeft hij mijn boek Les Tueuries du Brabant gekocht – Boutens eerste uit 2009 (jw). En inderdaad, het boek met de felgele kaft, een stuk van de Bendeaffiche voorstellend, ligt naast enkele prullaria op een tafeltje. En daar ligt zijn tweede ook op zijn plaats: bij de prullaria.”
De titel van mijn recensie luidde: ‘‘De Bende van Nijvel is een geriatrische club’. Dat is (bijna) ook zo, want de laatste overval had plaats in Aalst op 9 november 1985, x aantal jaren geleden dus. En volgens de meest recente berichten over het nog altijd lopende onderzoek door speurders in Charleroi, waar Boutens zijn CIA-verhaal zeer au sérieux is genomen, is men nu op zoek naar… overleden daders!!!
Als uitsmijter nog even dit. Buslik, inderdaad een gabber van Bouhouche en Beijer, werd als medeplichtige aan een diefstal op het tarmac van Zaventem (oktober 1982) veroordeeld met als enig concrete aanwijzing een foto die genomen was op een feestje in kleine kring. Daarop stond hij afgebeeld met een Cartier-horloge. Een soortgelijk ‘model’ was in Zaventem buitgemaakt. Toen Haquin en ik dit hoorden, keek ik mijn door de wol geverfde Fransstalige collega aan. Hij fronste de wenkbrauwen en zei: “Pauvre justice!”
Moraal van deze reactie: wie teveel wil bewijzen, bewijst uiteindelijk niks!

Een persoon aan wie ik dit artikel liet lezen, vroeg me volgende reactie te plaatsen.
Misschien wel de voorloper van Al-Qaeda, een eerste probeerseltje. Misschien heeft Bin-Laden Buslik wel bij Kemper Aviation geplaatst. Etc. Etc. Stof genoeg voor nog enkele indianenverhalen. Zo kunnen jullie doorgaan tot jullie allemaal Alzheimer hebben en, gezien dan nog enkel het lange termijngeheugen werkt, begint alles opnieuw. Dan worden Heldenverhalen geschreven in de trant van Robin Hood en Zorro. Toch wel leuke verhaaltjes allemaal.

In het lopende proces over de “ Bommeleeër” te Luxemburg verklaarde M.REULAND,de chef van de brigade mobile de la gendarmerie (BMG) :“A ses yeux, une “piste militaire” liée aux attaques était une hypothèse “que l’on pouvait sérieusement prendre en compte à l’époque de la Guerre froide”. Une hypothèse que M. Reuland avait formulée en 1986 dans un rapport destiné à sa hiérarchie. Il ne sait pas pourquoi cette piste n’a jamais été suivie, affirme-t-il dans une réponse à une question de la Défense.”Dans cette optique, les services de renseignement avaient toutes les connaissances nécessaires en vue de perpétrer les attentats. (…) Et ils avaient la possibilité de camoufler tout cela pendant trente ans”, a-t-il ajouté, provoquant l’étonnement des observateurs du procès.”
Indianenverhalen komen dus niet alleen van journalisten maar vinden hun ontstaan vaak bij de indianen zelf.
Hét probleem is dat cowboys als Reagan en Bush het altijd van de indianen hebben gehaald.Het is gevolg van wat Eisenhouwer in zijn Farewell adress juist omschreef : This conjunction of an immense military establishment and a large arms industry is new in the American experience. . . .Yet we must not fail to comprehend its grave implications. . . . In the councils of government, we must guard against the acquisition of unwarranted influence, whether sought or unsought, by the military-industrial complex. The potential for the disastrous rise of misplaced power exists and will persist”.
Ondertussen zijn er ook niet-idianen die bevestigen wat sommige Apachen beweren.
Ferdinando Imposimato,ere-ondervoorzitter van het Hof van cassatie,is een van de meest gerespecteerde Italiaanse magistraten.Hij was betrokken in de controversiële processen die zijn land heeft gekend als de ontvoering van Aldo Moro,de aanslag tegen Paus Johannes-Paulus,de moord op verschillende rechters in de strijd tegen de mafia.Hij schreef een opzienbarend boek “La Repubblica delle stragi impunite” ( de républiek van de onbestrafte tragedies).Daarin stelt hij dat “ Wij nu alles weten van de strategie van de terreur die door het netwerk Gladio,gesteund door de Italiaanse geheime diensten,in de plaats werd gesteld”.” Deze strategie diende om de opkomst van de linkse regeringen te beletten,en was georchestreerd door de CIA”.Ook een andere stellingname is niet van de poes : “De internationale groepering Bilderberg is betrokken in de tragische aanslagen van de jaren 1970 – 1980 in Italië,die vooreerst door fascistische cellen en dan door de mafia werden georganiseerd”.

Helaas is “La Repubblica delle stragi impunite” alleen in het Italiaans beschikbaar, doch is het overmoedig van Ferdinando Imposimato om een naam te plakken op het fenomeen waardoor het gemakkelijk wordt voor critici om tegenargumenten te gebruiken waarmee het kind met het badwater weggegooid kan worden. Persoonlijk vind ik de term Deep Politics/Deep State (http://en.wikipedia.org/wiki/Deep_politics) van Peter Dale Scott beter op z’n plaats.
De term gaat ruimer dan de afgebakende grenzen van een groepering en is fluide, overlappend, overtreffend en duister qua structuur. Een beetje zoals de Frankenstein-mythe, Al Qaeda.
Het idee van een COG planning (https://en.wikipedia.org/wiki/Continuity_of_government), van waaruit in de schaduw oa. contextueel een Gladio gegroeid is, heeft vele gezichten waar psychologische oorlogsvoering en terreur een tweede natuur vormen volgens het Hegeliaans principe om een beweging (motion) te creëren. Jammer genoeg bestaat de term GOTD niet (Continuity Of Totalitarian Dogma) dat een omschrijving zou kunnen zijn voor het verklaren van bepaalde bewegingen, veranderingen en gebeurtenissen via een kennisgerichte multitude van technieken en operaties.

Four years after hed been convicted of murder in Belgium, Jean-FranCois Buslik was a pilot and a family man living quietly in North Palm Beach. Then justice came calling.

A twin-engine Aerocommander dipped from the sky above Lantana's municipal airport. Caught in a gust the plane hovered above the tarmac before screeching to earth. Tearing past Pipers and Cessnas, ultralights and helicopters, the six-seater slowed to a halt at the mouth of an overstuffed hangar, propellers whirring. Jean-François Buslik stepped from the cockpit, headphones in hand, his ash gray Bill Clinton pompadour hair spray-fresh. There was a lilt in his stride, a crease in his khaki shorts, a smile beneath his upturned nose. He looked smug and self-satisfied -- like a man who'd gotten away with murder.

A reporter approached him. "You're a nuisance," he said, brushing off an inquiry in a halting French accent. "Get away from me. I don't intend to talk to you." He slammed the glass door leading into Kemper Aviation, where until last year he was the chief flight instructor, and disappeared into a conference room. The reporter, he hoped, would get the message and scram.

This encounter took place in late March, when Buslik, who for the longest time seemed a man beyond the law, was oblivious to legal machinations taking shape. In less than a month, United States Marshals, reacting in part to a New Times investigation begun in February, would swarm his home in North Palm Beach, placing him under arrest for murder and shattering the veneer of respectability he'd spent much of the last decade building in South Florida.

Before his arrest last Thursday, Buslik, whom many at the tiny jetless airport at Lantana describe as the best pilot to scream up and down the tarmac, was a man without a past. An intensely private and enigmatic figure, he had been lurking around the airport since the late '80s, teaching hundreds how to fly and shuttling cargo and wealthy weekenders to and from the Bahamas. As a flight instructor, he was a lure for Europeans looking for a quick and inexpensive route to flight readiness and a valuable resource for young pilots, many of whom described him as a "walking bible on aviation." He was also, according to many at the airport, "cold," "cocky," "unfriendly," and a "real jerk."

Although he earned not much more than pilots 15 to 20 years his junior, the 46-year-old Buslik never really seemed strapped for cash. With his expertise and many hours in the sky, he could easily have qualified for far more lucrative positions flying for the big airlines. He never tried for them, though.

"I just figured his wife had money or he had family funds," says Kathy Kemper, owner of Kemper Aviation, who worked with Buslik for many years but says she knows next to nothing about the man. Neither Kemper nor any of a half-dozen pilots interviewed at the airport ever went for a drink or a meal with Buslik. None of them ever played cards or barbecued steaks at the quarter-million-dollar waterfront home in North Palm Beach that he shared with a former flight student, now his wife, Diane Somerville, and her young daughter. None ever sailed on the 22- or 54-foot sailboats moored behind the house or went for a spin in the $80,000 Cessna 210 with which he was always tinkering at the airport. "He kept to himself, and I have never been one to be nosy," says Kemper. "He didn't let anybody get close to him," adds Doug Beggs, another pilot. "He was pretty much all business."

There is a very good reason why Buslik, who is licensed in Florida to carry a concealed weapon and often carried one at the airport, was always so reticent to share the details of his life. Tales of murder and grand larceny can be real conversation killers, even if they occurred in a distant place many years ago.

The key to the mystery Jean-François Buslik kept hidden from all who knew him in South Florida lies 5000 miles away in Belgium, in the heart of Europe, where four years ago he was found guilty of a murder committed 13 years earlier and sentenced to death. Buslik was not in court to mount a defense then. Instead he was in South Florida, land of sunshine and second chances, striving for anonymity, trying to disappear. Until last January, when Raf Sauviller, a magazine journalist, found Buslik's name and address on the Internet and published it in Belgium, he seemed to be succeeding in his quest to vanish in South Florida. Before his arrest the Belgian judiciary, which, contrary to press reports, had known of his whereabouts for years, hadn't bothered him in more than a decade, and until recently the Belgian press seemed largely to have forgotten about him.

Buslik was never really hiding, and Belgian authorities never really looked for him. He got married, opened businesses, got a driver's license and a concealed weapons permit, all under his real name. It wasn't until 1997 that the man known for 45 years as Jean-Francois Buslik ceased to exist. Legally adopting his wife's last name, he became Jean-Francois Somerville, although everyone knew him as Gene Buslik. For more than a decade, the fugitive whose name has appeared in more than a dozen books published in Belgium was hiding in plain sight. He should have been extradited long ago but instead found refuge not in some Third World banana republic but right here in the United States of America.

Today, after four years of allowing Buslik to remain free, the Belgian and American governments are engaged in artificial hand-wringing, declaring Buslik's capture a victory of international law-enforcement cooperation. Why, then, did it take so long to arrest him? A source at the American Embassy in Brussels claims that officially the embassy does not know why the Belgian government is seeking Buslik's extradition at this time. The official, however, speculated that the action might have been prompted by the publication of Buslik's U.S. address in a Belgian magazine and subsequent inquiries by a New Times reporter, who discovered that Buslik is suspected of having been involved in more than just one murder in his native country.

Under the extradition treaty between the U.S. and Belgium, Buslik has long been extraditable. Many blame Belgian judicial bungling for his years of freedom. The country's courts and law-enforcement agencies are notoriously disorganized, as was so publicly exposed three years ago when a pedophile murder scandal shook the country and threatened to topple its government. Belgium is home to 589 local police departments, two national police organizations (the judicial police and the Gendarmerie), and an internal security agency (the Surete). None of these groups communicates well with another. (The child-killer, Marc Dutroux, who had two young girls chained up in his basement and four others buried in his yard, slipped through police hands on more than one occasion because of lack of communication.) Add to that widespread corruption and a country intensely divided along French and Flemish language lines, and you have a real recipe for bureaucratic disaster. In the case of Jean-Francois Buslik, even the country's own Ministry of Justice is unable to explain his years of freedom.

"It's very strange, but the attorney general of Brussels never issued an arrest warrant," said Eric Verbert of the extradition division of the Belgian Ministry of Justice weeks before a provisional request for extradition reached that office. Contacted a few days after Buslik's arrest, Attorney General Pierre Morlet, the man who prosecuted Buslik's case four years ago, said the extradition delay was the result of an "administrative error." "We presumed he was in Florida, but we never had precise information about his whereabouts," he said. "We took action after police discovered his address on the Internet." That action, which led to his arrest on April 15, means that a man who nearly got away with a murder going back 17 years will finally return home to face his accusers.

The crime for which Buslik was sentenced to death was set in motion on the afternoon of October 25, 1982, when an invoice arrived by telex from Zurich to the security office of Sabena, the Belgian national airline. The printout listed the contents of a shipment scheduled to arrive at Brussels International Airport the following evening. Included on the list were 950 Krugerrands, 50 Italian gold coins, 50 pounds of gold bullion, 4.5 pounds of industrial diamonds, a large stack of cash, and a dozen Cartier watches. The total value: more than $4.5 million. Upon arrival the precious Swiss cargo was to be transported to a high-security safe at the edge of the airport. It would never reach its destination.

A 25-year-old security guard and recent first-time father named Frances Zwarts was assigned to accompany the shipment as part of his regular rounds. On the evening of October 26, he dashed to a flight from Moscow to grab a diplomatic pouch from the Belgian Embassy in the Soviet Union, then greeted the plane from Zurich as scheduled. He loaded the valuables from the cargo hold into a blue Sabena Volkswagen and set off across the tarmac toward the secure warehouse at Brucargo.

The route he followed passes under an overpass where two Sabena employees later described seeing a roadblock and three uniformed men with machine guns. The pair of witnesses told investigators they assumed the men, who waved them on, were police officers. So, presumably, did Zwarts. His Volkswagen was found abandoned the following day. It was empty except for his 9 mm handgun and the broken wax seal from the diplomatic pouch. That same day street cleaners found by the side of the road a banged-up black suitcase containing a pistol, a machine gun, and a number of wigs. Zwarts was never seen again. Although his body has never been found, he is presumed to be dead.

Six years later, on December 15, 1988, a trio of Belgian investigators flew into Miami International Airport. Contacted through his lawyer in Belgium, Jean-Francois Buslik had agreed to meet with the men to answer questions about the airport heist. He drove to the hotel where they were staying, the Sheraton Brickell in Miami. "We didn't know where he lived, and he didn't want us to know," recalls Jean-Pierre Doraene, then an investigator with the judicial police. Over the next four days, Doraene and two others grilled Buslik about the jumble of evidence linking him and two associates to the robbery and the murder of Zwarts. They showed him a photo they had recovered during a search of his home in suburban Brussels. It pictured an old girlfriend done up for New Year's Eve festivities. Clearly visible on her wrist was a Cartier watch later identified by an expert as being one of only half a dozen like it in the world. Buslik claimed the watch was a fake he had bought for his girlfriend. "He denied everything," says Doraene. "He said he had nothing to do with the robbery, that he left the country because he was sick of being harassed by the police.... His answers weren't very convincing."

A few months before their trip to South Florida, the investigators had scoured Buslik's home and business in Belgium. They found guns without serial numbers, pictures of jewels, precision machines for jewelry, and computer equipment. In the basement of his house, they found shell casings and what looked like bullet holes in the walls. In the kitchen was a safe-deposit box containing a stamp collection, 13 passports, and Iranian and Israeli money. They contacted Graziella Davilla, the girlfriend in the picture, who said that, a few days before New Year's Eve in 1984, Buslik had pulled from his basement a plastic bag containing four Cartier watches and had told her to choose one. "I thought it strange that he would keep such valuables in the basement when I knew he had a safe in the kitchen," she said.

Also strange was the rash of large purchases that preceded Buslik's hasty departure from Belgium in 1987. The investigators discovered that he had paid cash for a small fixer-upper of a house near London and then sold the property, using the money to buy a 54-foot sailboat through an offshore shell company in the Channel Island of Guernsey. (That boat later wound up docked behind his house in North Palm Beach.) Michele Ergot, another girlfriend, told police she had turned down an invitation from Buslik to sail around the world with him. Years later in South Florida, Buslik would tell a former flight student of his desire to cruise the high seas. "He loved that boat," said the former student, who asked not to be identified. "He said as soon as his father died, he would sell everything and head to sea for two or three years." Buslik's father, who lived with his son in South Florida in the last years of his life, died in 1994. By that time, though, Buslik had taken on new responsibilities: Diane Somerville and her daughter.

Despite his informal 1988 not-guilty plea from afar, the evidence against Buslik was enough to convince prosecutors to charge him with murder, which in 1995, 13 years after the airport robbery, led a panel of judges to find him guilty and sentence him to death. Until recently the sentence -- he received the maximum penalty because of his absence -- brought with it no arrest warrant and no request for extradition. Robert Beijer and Madani Bouhouche, two former police officers implicated with Buslik in the crime, were in the country to face trial; they received lesser sentences of 14 and 20 years respectively. The death penalty has since been abolished in Belgium, and if he is successfully extradited in the coming months, Buslik will likely receive a reduced sentence after being retried on the same charges.

Although a considerable fortune was snatched at the Brussels airport in 1982, the robbery is not the reason that Buslik and his coconspirators received such public notoriety in Belgium. Their media status, at one time on the level of O.J. Simpson or Timothy McVeigh, resulted from their suspected connection to 28 unsolved murders that took place around Brussels in the mid-'80s.

Belgium, a sleepy, rain-drenched country best known outside its borders for its waffles, French fries, and monk-brewed beer, was once one of the most volatile countries in Western Europe. At the height of the Cold War, Brussels, the seat of NATO and of the European Community, was second only to Berlin as a chessboard of covert activity in Europe. The place was crawling with spooks of all persuasions -- KGB, CIA, Mossad -- and with arms dealers, drug traffickers, terrorist groups (of the extreme right and left), and organized crime figures. In the '80s and early '90s, the country exploded with violence, from attacks on NATO targets and Western diplomats to political assassinations and terrorist assaults on civilians. Between 1982 and 1985, a masked, shotgun-wielding band attacked suburban supermarkets around Brussels, leaving 28 people -- including women and children -- dead.

The attacks, initially attributed to a terrorist organization called the Fighting Communist Cells and later pinned on a gang dubbed the "crazy killers of Brabant" for the province where the incidents occurred, remain unsolved, though a slew of theories has emerged to explain them. The most popular theory tossed around in the press and in parliamentary inquiries postulates that the killings were part of a right-wing plot to destabilize the country, undermine Communism, and strengthen the police state. Many believe, because of the commando tactics used in the assaults, that the killers may be connected to Belgian police or security forces, which is where Buslik and his pals enter the picture. Although they have never been formally charged with any of those murders, they remain the only suspects ever incarcerated for suspicion of being connected to them. The investigation, now comprising more than 300,000 pages of documents, continues. Buslik and former police officers Beijer and Bouhouche remain active suspects. Investigators into those murders are looking to question Buslik and are therefore anxious for his return to Belgium.

Before retiring in scandal in 1983, Bouhouche, whose father was North African, was well known on the police force for his extreme-right, neo-Nazi sympathies and for his affiliation with the Belgian neo-Nazi organizations Westland Newpost (WNP) and the Youth Front. According to Martial Lekeu, a former right-wing police officer who fled to Orlando in the '80s (he died of cancer a few years ago), Bouhouche was the core of an underground law-enforcement organization known as G Group. Lekeu told Belgian magazine reporter Gilbert Dupont that the group, which investigators confirm existed, started planning a right-wing coup d'etat in 1975. The G Group manifesto, published in 1990, calls for an organized struggle against the "red peril." It concludes with this bit of hyperbole: "For all time men of the west have fought against the eastern hordes and they will continue to struggle against them as long as they put our values, customs, and traditions in danger." Along with political organizing, G Group members, according to Lekeu, were fond of thrusting Nazi salutes and goose-stepping while on the job. Bouhouche, in whose house investigators found pictures of Adolf Hitler, never mentioned G Group. He did, however, admit to being involved with the WNP, a group he claimed to have infiltrated in the course of undercover police work.

During the 1988 interrogation in Miami, Buslik blamed his legal trouble in Belgium on his affiliation with Bouhouche. The two have known each other since childhood. In the '50s and '60s they attended the same schools around Brussels where they became fast friends. By the early '80s, though, their childhood pranks had given way to larceny and murder. Buslik, who got a bachelor's degree in electronic engineering in 1974, was a computer whiz and an adventure addict -- pilot, marksman, rock climber, motorcyclist, and sailor. He often accompanied Bouhouche, an avowed gun fanatic, to rural shooting ranges where right-wing, law-enforcement types would fire off high-tech military assault weapons. Bouhouche seemed to accord him absolute trust. Buslik was one of only three people who had a key to Bouhouche's house, and he was godfather to Bouhouche's son David. Buslik, in return, pledged his loyalty to Bouhouche, a man he clearly admired.

"I think Buslik is someone who doesn't have very many friends," says Doraene. "He's reserved; that's his character. Still, he really seemed to respect his friendship with Bouhouche."

That respect drew Buslik into the inner circle of what has become known in the press in Belgium as the "bande a Bouhouche," or the Bouhouche gang.

Bouhouche's criminal organization first took shape in the '70s when he and his partner on the Brussels vice squad of the Gendarmerie, Robert Beijer, began to realize they could exploit their law-enforcement status for substantial monetary gain. Bouhouche, Beijer, and Buslik formed the core of the group, which included at least two other police officers. Investigators believe Buslik was the group's technical troubleshooter, the one who made the bombs, listening devices, and fake license plates. "He had a lot of talents," says Doraene.

Where he acquired all those talents is the question at the core of the Buslik mystery. Of all the members of the Bouhouche gang, Buslik remains the one about whom the least is known. The Belgian press has linked him to everything from the U.S. military to the CIA, DEA, and FBI. He has often been described as a DEA informant and has been closely linked in the press to a DEA agent named Frank Eaton, the top-ranking American drug agent in Brussels in the late '70s. Eaton helped set up the federal antidrug squad in Belgium, a law-enforcement organization that fell into considerable disrepute when its chief, Leon François, and most of his officers were charged with drug trafficking in 1982. Eaton, who was also charged, had already left the country and was protected under diplomatic immunity. Neither Eaton -- now an investigator with the district attorney's office in San Diego -- nor his successor in Brussels, Glenn Cooper, admits he ever worked with Buslik, and Buslik's name does not appear on the DEA's official list of Brussels informants.

Although he may not have been working for the DEA, evidence exists connecting Buslik, through Bouhouche, to the world of illicit drugs in Belgium. In 1981, investigators believe, he helped Bouhouche and Beijer install listening devices in the offices of other police officers, including the office of Maj. Hermann Vernaillen, the man in charge of the corruption investigation of Leon François' antidrug squad. Later that same year, a bomb misfired in the trunk of a Peugeot 404 that was meant to be carrying Guy Goffinon, another police investigator active in the corruption investigation. Goffinon was not in the car, and the police who were there were not injured. Buslik, who was picked up for questioning following the blast, admitted to building the detonation device used to set off the bomb but claimed it was merely a garage door opener he had sold to an acquaintance. (Today Belgian authorities say they have collected enough evidence to charge him with that crime.) Two days after the blast, gunmen assaulted Major Vernaillen outside his home. He was shot in the back but survived. Guns traced to the attack were later found in a vehicle linked to Buslik's old friend Madani Bouhouche.

Buslik's CIA connection is even more tenuous than his connection to the DEA. His father, Max Buslik, a German from Leipzig, may have worked for the American intelligence agency at the end of World War II, but little evidence exists linking his son to the agency. After the war Max lived briefly with his French wife in New York City, where she gave birth to Jean-François, their only child. In 1949 Max founded Aviation Benelux, a small charter aviation company in Brussels that reporters in Belgium suspect had ties to American intelligence. The family company also operated a military surplus store called Surplus 13, which Jean-François took over in the late '70s after his father fell ill. Investigators say the junk heap of a store -- crowded with helmets, clothing, and rusty military hardware -- didn't do much business and was most likely a front for the younger Buslik's more lucrative criminal activities. "It wasn't busy," says Pasquale Conedera, an Italian who used to work at the shop stocking shelves and cleaning up. "There was junk piled everywhere. It was nearly impossible to find anything."

In the early '80s, a Belgian military intelligence officer named Andre Moyen investigated Buslik on suspicion he was trying to sell American aviation technology to the Soviet Union. Moyen, who at the height of the Cold War funneled information to a CIA front called the World Anticommunist League, thinks Buslik promoted himself as an American agent as a way to increase his underworld credibility. "He was a fake secret agent," says Moyen, now 84 years old and retired. "At any given time, he would present himself as being part of the CIA, the FBI, and the DEA."

Although the murder in 1982 of Frances Zwarts is the only crime for which he has been convicted, a litany of criminal actions has been ascribed to Jean-François Buslik, either directly or through his connection to Bouhouche.

Along with the bomb attack on Guy Goffinon in 1981, Buslik was also picked up for questioning in connection with the murder five years later of Juan Mendez, an engineer in charge of Latin American sales at Belgium's largest weapons manufacturer. Mendez, a close friend of Bouhouche and a gun fanatic, was found dead in his car on January 7, 1986. He had been killed execution-style -- shot four times in the head and twice in the chest -- by a 9 mm GP Sport Parabellum, a gun later recovered at Bouhouche's home. During their investigation police discovered that Mendez and Bouhouche may have been involved in some sort of criminal enterprise together. They had both been spotted in a stolen Mercedes four-by-four identical to one belonging to a manager at Abelag, a private aviation company where Buslik had learned to fly. The car, with plates matching those on the manager's car, would allow the men to pass freely in and out of secure areas at Brussels International Airport.

Buslik was arrested after police, who had put the car under surveillance, spotted him retrieving the vehicle from its parking space near a Brussels hospital. They later recovered from his answering machine a poorly timed message from Beijer instructing him to "stay away from the Mercedes." He was released after a few days' detention, then picked up again after police received information that he had obtained military documents on making bombs. A few days later, though, he was again set free.

On May 15, 1985, nine months before the killing, Mendez's substantial collection of high-tech guns was swiped from his home by unidentified thieves. The break-in called to mind a similar robbery four years earlier when the arsenal of the antiterrorist brigade of the Belgian federal police was sacked by thieves who made off with dozens of assault rifles. Investigators believe both collections wound up in the hands of Bouhouche, who had opened a gun shop in Brussels after leaving the police force and was suspected of selling guns to right-wing rebel groups in Lebanon and Algeria. Some of the stolen guns have long been suspected of being used in the supermarket attacks. A number of weapons were later discovered in abandoned vehicles and in storage lockers rented by Bouhouche and Beijer under false names. Also discovered in the course of the investigation was a secret tunnel under an abandoned restaurant that Bouhouche and company had planned to use as an escape route in the late '70s in an elaborate plot to extort money from the country's largest supermarket chains.

The plot, detailed by Bouhouche's former police colleague Christian Amory during an interrogation, consisted of setting off explosions near supermarket gas mains in order to create an atmosphere of terror. Fear, it was hoped, would encourage supermarket owners to pay huge sums to protect their stores from attack. This complex plot was never executed, although it bears an eerie resemblance to the brutal attacks later carried out on suburban supermarkets around Brussels. These days Amory, who served six months in prison as a result of his ties to Bouhouche, isn't talking about the events of those tumultuous years.

"If I start talking about this old story, it will create all sorts of new problems," he said by phone from Belgium. "I am sure there are people listening in on my conversations."

Considering the attention these cases have gotten in Belgium, Amory may not be exaggerating. That might explain why Buslik fled that country at the first sign of trouble.

Following the airport heist and 14 weeks of incarceration stemming from the investigation into the bomb blast on Guy Goffinon's Peugeot 404, Buslik hightailed it to Italy, according to police. What he was doing there remains a mystery, though investigators are certain he returned to Belgium by 1985, in time for the murder of Juan Mendez. In that same year, he paid cash for a small home near London. After he was released from custody during the Mendez murder investigation, Buslik settled in London for a short while before taking flight to the United States.

In that same period Bouhouche, Beijer, and a number of former right-wing police officers connected to them were scattering to the far corners of the world. Bouhouche was picked up in southern Spain in 1989 and held in custody until his trial five years later. Beijer was picked up in Thailand. Two others fled to Paraguay. Three, including Buslik, fled to Florida. Christian Pattyn and Martial Lekeu, both former colleagues of Bouhouche, settled in Clearwater and Orlando, respectively. Buslik, upon his arrival in Florida, is believed also to have lived briefly in Orlando before heading south, living in Vero Beach, then Boynton Beach, and for the last few years, North Palm Beach.

In Palm Beach County, in his quiet slice of suburbia, Buslik was always careful not to draw attention to himself. He drove a white Ford Escort station wagon, separated his recyclables, and kept his past, like his revolver, hidden away. His low-key lifestyle, though, would not save him from the U.S. Marshals.

At 4 a.m. last Thursday, Deputy Marshal Lou Vega and four colleagues crept through the predawn shadows along Lagoon Drive in North Palm Beach. The request for a "discreet investigation" had arrived from Interpol in late February, prompting several weeks of surveillance. The Marshals had watched Buslik at his home, trailed him to the airport, and snapped photos using a camera with a long lens. The images were sent via electronic mail to Belgium, where they were shown to Bouhouche and Beijer, who confirmed Buslik's identity. The bureaucratic trail for clearance was a circuitous one. After identification was confirmed by the attorney general of Brussels, the following agencies had to be notified: the Belgian Ministry of Justice; the Belgian Foreign Ministry; the Belgian Embassy in Washington, D.C.; the U.S. State Department; and the U.S. Justice Department. Finally, last week, the go-ahead reached Lou Vega in West Palm Beach.

"We were told to be careful," says Vega. "They said we were dealing with a cop killer."

His squad arrived early on April 15 to scope out the neighborhood and make sure Buslik wasn't waiting for them. After sweeping the perimeter of 728 Lagoon Dr., the Marshals split up. Vega and another deputy stationed themselves in a blind spot along the right side of the house. Two others eyeballed the front door from a hiding place across the street. In the canal behind the house, officers watched the back yard from the deck of a small boat. At about 8 a.m., in shorts and sandals, Buslik opened the front door, walked outside, took a deep breath of fresh air and then strode back up the driveway, pausing in the open doorway in a sleep-encrusted daze. Vega and the others rushed the door, grabbed their fugitive, and slapped on the handcuffs. "We are placing you under arrest for crimes committed in Belgium in 1981 and 1982," Vega told Buslik. His wife and stepdaughter broke into tears.

"I thought there was something strange going on," Diane Somerville told Vega as Marshals searched the house for armed accomplices. "A reporter has been calling here saying all sorts of things about my husband."

In a closet a few feet from the front door, deputies found a Remington semiautomatic rifle. Under Buslik's mattress was a 9 mm Glock semiautomatic handgun. In the garage were hundreds of bullets, two more revolvers, and an olive green military munitions box containing 200 machine-gun rounds.

Buslik was booked into the Palm Beach County Jail awaiting transfer to the Federal Detention Center in Miami. There he will remain until a formal extradition request replaces the provisionary request currently on file. The Belgian judiciary has 75 days to file the request along with a translated summary of the charges facing Buslik. In that time Buslik will remain in custody without any possibility of bail. He no doubt will fight extradition through both his American lawyer, Martha Eskuchen, and his Belgian lawyer, Jean-Paul Dumont, who plans to be in Miami within the next few weeks.

Although the Brussels attorney general blames Buslik's years of freedom on a simple "administrative error," before Buslik's arrest many other theories had circulated in Belgium to explain his absence. Some reporters (and a few lawyers) were under the false impression that Buslik was protected because he is an American citizen. In fact Buslik does carry an American passport, which means that, although the Immigration and Naturalization Service could never have deported him, he was always eligible for extradition to Belgium. Although some countries, including France and Belgium, don't extradite their own citizens, the U.S. does.

Another scenario touted in the Belgian press is that Buslik was being protected by either the American or Belgian government. Though no evidence supporting that assertion has so far emerged, even investigators like Jean-Pierre Doraene don't dismiss it out of hand.

Whatever the reason he eluded capture for so long -- bureaucratic bumbling or deliberate sabotage -- in the last few months something prompted the Belgian authorities to take action to quash the embarrassment his freedom was fast becoming.

(...) Rond het midden van september 1962 zijn een half dozijn T-6′s geland in Kolwezi, het eerste deel van een serie van tien toestellen die besteld werden bij Cogea in Oostende. Normaal bestemd om te dienen als antiguerilla-vliegtuigen, werden ze door de Portugezen aan Katanga geleverd zonder bewapening. Van zodra ze aankwamen in Katanga, werden ze voorzien van mobiele systemen voor bommen van 50 kilo. Samen met de vliegtuigen arriveerde een ploeg van een tiental piloten en een aantal Poolse mechaniciens, die gerecruteerd waren door ‘kolonel’ Jean Zumbach. (2)

Diezelfde Jean Zumbach was eerder ook gesignaleerd op de luchthaven van Deurne. Op 3 mei 1962, de dag waarop er zes Harvards in Deurne zouden landden, arriveerde de ‘kolonel’ aan de stuurknuppel van een klein personentransporttoestel van het type De Havilland Dove. “Dit vliegtuig kwam vier piloten opladen om hen naar Genève te brengen”, wist de politie, “waar ze elk een Harvard moesten gaan halen om het toestel naar Deurne over te vliegen.” Zumbach, die zich ook ‘Colonel Johnny Brown’ liet noemen was een Poolse piloot die tijdens de Tweede Wereldoorlog had gediend in de Britse Royal Air Force. Hij was in 1962 door Tshombe ingehuurd om de Katangese luchtmacht uit te bouwen. (Vijf jaar later, in 1967, deed Zumbach precies hetzelfde voor de opstandige provincie Biafra in Nigeria, GT.) (...)

(...) Jan Zumbach, après la guerre, mène une vie d'aventurier. Il est copropriétaire d'une société d'avion-taxi et s'occupe à faire de la contrebande.

En 1962 il répond à l'offre de former et de commander l'aviation du Katanga. Il organise l'achat d'appareils Douglas A-26 Invader qui sont devenus le pilier de l'armée de l'air du Katanga et recrute des pilotes et des mécaniciens.

En 1967, on lui propose de devenir le commandant en chef de l'aviation du Biafra. Il accepte et participe personnellement au bombardement des forces gouvernementales du Nigéria.

Jan Zumbach meurt à Paris, le 3 janvier 1986 dans des circonstances inexpliquées. L'enquête sur sa mort a été close sans révéler au public ses résultats (...)

Après l’île de Socotra, au large de la Somalie, Pierre Chomé partira aux Philippines puis aux îles Galapagos.

Tel avocat se distingue (!) par de la publicité ou du démarchage, tel autre se ressource dans les fonds marins. Tel est le cas de Pierre Chomé, par ailleurs assistant en droit pénal et en procédure pénale à l’ULB. Le trophée le plus médiatisé de son tableau de chasse judiciaire est l’acquittement de Buslik en 2001 alors qu’il avait été condamné à mort par contumace pour la disparition de l’agent de sécurité Swars à Zaventem. Il détient aussi le record de plaidoirie en assises, 27 heures en 1995 pour défendre Beijer dans l’affaire Mendez.

Dans son arrêt rendu mardi, la cour d'assises de Bruxelles-Capitale a balayé les objections soulevées par la défense puis a entamé le procès de l'Américain Jean-François Buslik, accusé de participation à un attentat manqué à la bombe, contre une Peugeot de la gendarmerie, le 11 octobre 1981, et, le 25 octobre 1982, à l'attaque d'un combi Sabena piloté par l'agent Francis Zwarts (probablement tué) qui convoyait cette nuit-là un chargement d'or, de montres et de diamants.

Buslik, New-Yorkais de naissance, a grandi à Saint-Josse où ses parents tenaient un stock américain rue Verbist. En fils attentionné, il interrompit ses études à l'ULB après la thrombose qui handicapa son père, pour aider ses parents jusqu'à la fermeture du stock américain, en 1981.

Des éléments du mécanisme saisi après l'attentat manqué du 11 octobre 1981 provenaient d'un magasin Tandy dont le gérant indiqua les avoir vendus à l'exploitant du stock américain de la rue Verbist. Ce qui permit au gendarme Bouhouche, qui enquêtait, d'identifier son vieil ami Buslik. Un certain Jean, que je ne connaissais que par son prénom, m'avait demandé une idée pour utiliser la CB pour l'ouverture d'une porte de garage. Je lui avais fait un montage , explique l'Américain. Un récepteur Daiwa de NCR Electronics provenait de Braine-l'Alleud où il avait été facturé à un certain Jean De Knop. Il n'avait pas de voiture et m'avait demandé de l'y conduire à moto. J'ai toujours aidé les gens , explique Buslik. Les 24 piles alcalines vendues dans un autre Tandy? A Buslik, selon le gérant. Buslik réagit. Je ne les ai pas achetées. Il a dit cela des mois plus tard, sous je ne sais quelle pression.

Détenu et voulant collaborer à l'enquête, Buslik fit des esquisses de ce «Jean»: ça ressemblait à Bouhouche. Buslik se demande s'il n'a pas été manipulé, si la commande n'avait pas été demandée à Jean par Bouhouche.

On saisit aussi chez lui la formule de l'explosif, sortie d'un syllabus d'un ami agent à la Sûreté de l'Etat, qui la lui avait cédée sur son insistance. J'étais curieux de tout, répond Buslik.

Quant au vol d'or à Zaventem, il rapporta gros. Buslik affirme: Je n'ai participé à rien. J'étais alors en Allemagne, engagé dans l'armée américaine. Et la montre vue au poignet de son amie, semblable à une Cartier volée à Zaventem? J'avais acheté des répliques de Cartier à Bouhouche. J'en avais offerte une à Graziella.

La maison achetée et payée comptant en 1985 à Stratford? J'avais de l'argent de côté. Le bateau Chiby acheté pour 3 millions à Nieuport en 1987? Avec le produit de la revente de la maison de Stratford. Ses pièces d'or? Mes parents me les avaient données, en cas de besoin , répond poliment cet Américain un peu trop tranquille...

Jean-Francois Buslik, the fugitive from European justice whose arrest in North Palm Beach two months ago was sparked by a New Times investigation, seems desperate to stall the extradition process.

In an odd twist Dave Bogenschutz, Buslik's high profile Fort Lauderdale lawyer, has put our story at the center of his defense strategy. The piece appears in the court file as defense exhibit II. The article, Bogenschutz argues in a motion for bond, shows how the Belgian judiciary had in an "egregious violation of human rights" tried and convicted Buslik in his absence and never before sought to snatch him from his South Florida refuge.

What Bogenschutz fails to mention are the myriad crimes detailed in the article or the convenient timing of Buslik's enlistment in the United States Army. Buslik, New Times recently learned, signed on for active duty at the American base in Kaiserslautern, Germany, in 1982 shortly after he and at least three accomplices were suspected of killing an airport guard and making off with millions of dollars' worth of valuable cargo. He served a year in the Army (could there be a better place to hide?) at Fort Jackson, South Carolina before heading back to Belgium, where he is suspected of being involved in a number of other crimes that might have inspired his move, a decade ago, to South Florida. Assuming the Belgians don't botch the paperwork, his final extradition hearing is scheduled for early July.

SAMAIR is a part of an international evangelical/Pentecostal air wing, often drawing on former military pilots, who are not accidentally often found in areas in the middle of civil wars, drug gangs, and mercenary intelligence operations in Third World countries. Additionally, Joe Kemper’s chief pilot trainer between 1989 and 1999 was Jean-Francois Buslik, who was later arrested on murder charges filed in Belgium, Buslik was implicated in the 1982-85 Brabant killings, a wave of serial killings and de facto strategy of tension which claimed the lives of over 30 victims at supermarkets in the Brussels suburbs.

Néanmoins Zumbach a fait une carrière. Pologne, il avait laissé comme un simple lieutenant; Pendant la guerre, il a augmenté au grade de colonel et commandant de l'escadron. Sa liste de succès qu'il ne pouvait pas se développer plus, mais sinon il passé un bon moment. Il était un héros, le whisky et la vodka coulait à flots et les femmes anglaises n'étaient pas des aventures aversion. Son salaire il a amélioré de ce fait par la contrebande des diamants il sur ses vols de service pour un Juif polonais.

il a rapidement réalisé que l'achat de matériel de guerre, le grand argent était à ramasser. Son salaire officiel n'était pas beaucoup plus qu'une pointe; parce que, par sa part des primes sur le marchand d'armes, il pourrait rapidement gagner des millions

Under Florida Statute 784.03, the crime of misdemeanor battery occurs when a person either:

Intentionally touches or strikes another person against their will; or

As you can see, a battery can occur from something minor, such as grabbing another person's arm; or a battery could also occur by throwing something that strikes another person.

Importantly though, when it comes to touching or striking a person, there is no requirement that the person be injured - the non-consensual contact is sufficient.

The local market on Friday offered fresh produce at a fair price and clothing, shoes, etc. We loved the museum (only 2 E each) and actually learned a few things about the life of the people in a fishing port instead of just getting a view of artifacts…children were used to spin the wheel making hemp rope for 15 hours a day and trees were selected by their original shape to match the final outcome on the boat. A stroll at night makes this a perfect stop. Every night around 9 pm, while I am laying down and reading, I hear the hooves of a horse. JF says it is a black horse and carriage driven by driver also in black. We wonder who is inside.

Concernant l'article de René ''Quinquin'', grand journaliste et homme courageux, une précision qui va en faire rire + d'un:
L'explosif, incomplètement brûlé dans la Peugeot de la B.S.R. a été analysé et ses divers composants isolés, avec leur exacte proportion ( Bravo nos chimistes judiciaires.) et ce pendant la première incarcération du ''suspect''. ( Au trou de fin octobre 1981 à mars 1982. -Approximativement)

Suite à la libération du voyou, malgré les éléments de la radio commande qui le lie aux faits, un inspecteur de la SE prend contact avec lui et le rencontre dans un café de St Josse. Le gars prétend qu'il n'a rien à voir dans l'affaire et que l'explosif était du genre T.N.T.
L'inspecteur, qui sait que Buslik lui ment, lui demande alors s'il a toujours la feuille de papier avec la formule et le gars va à sa moto , soulève le siège , et ramène la feuille de papier...

Ce document sera remis quelques semaines + tard à la B.S.R., en présence du Lt Brams . Il faudra insister pour obtenir rédaction d'un P.V. ....
La feuille est couverte des empreintes digitales de Buslick.
Elle n'a pas été trouvée lors d'une perquisition, mais remise à la Gie par l'inspecteur en avril 1982.

L'art. d'origine US est rempli d'excellentes précisions, en particulier sur l'alibi de présence de Buslik dans l'armée US, dont les dates de présence sont plus explicites qu'un long discours.

Buslik est aussi accusé d'avoir détenu des explosifs pour avoir en 1981, peu avant l'attentat manqué, insisté auprès d'un de ses clients, agent de la Sûreté de l'Etat, pour obtenir des formules d'explosifs.

Une affaire qui agace encore l'agent de la Sûreté, Gérald Damseaux, qui dit avoir été empoisonné par les multiples convocations reçues et par la parution de son nom dans la presse. Tout ça lui valut un blâme non mérité. En 1981, Buslik me disait qu'il partait comme pilote en Afrique et que, s'il devait un jour assurer sa fuite, ça lui permettrait de faire sauter un pont derrière lui. J'ai fini par lui refiler mes notes, mais de manière incomplète. Sans le chapitre relatif au confinement. Je ne lui ai pas expliqué comment on fabriquait de la nitroglycérine ni le mode d'emploi.

Le procès Buslik se poursuit lundi avec les auditions de l'ex-épouse de Bouhouche et des amies de Buslik. Puis, si la Cour réussit à le débusquer, avec celle de l'ex-gendarme Bouhouche.

A cruise through Greece

Here is a cruising update from Diane and Jean-Francois Somerville (photographers of this week’s cruising shot!). They cruise the Med three to four months of the year and are currently en-route to Marmaris, Turkey.

“We heard rumors, we analyzed satellite weather reports, we predetermined our route and alas, one quarter of the way through our fall journey we have had the misfortune of not one, but two Meltemis...a famous Greek wind that sweeps across the Aegean. The name sounds romantic and oddly soothing but the reality is that this dry wind blowing from the north sweeps across Greek waters for days, swamping small craft, challenging ferries, and shutting down hydrofoils. On our way to Lavrion, near Athens, for a rendezvous with friends, the Beaufort scale indicated Force 7 that regularly and suddenly turned into Force 8 gales. Life before Meltemi, onboard Seatern for our fall voyage, had resumed the idyllic routine of calm seas, leisurely broad reaches, all systems working, secluded beaches and welcoming townspeople in each port. I must say, however, we were warned by virtue of our dinner setting in the Plaka neighborhood of Athens...we were seated immediately in front of the Tower of Winds!

Initial ports of call included a return trip to Galaxhidi to purchase sweets at a preferred bakery and Corinth. A day trip (by car) in the Peloponnese proved worthwhile. We visited the World Heritage sites of Epidaurus, the birthplace of the healing god Asklepios (Apollo’s son), and Mycenae, where the tombs of Agamemnon (of Troy fame) and his wife Clytemnestra were worth seeing. (Tholos architecture). Napflio, a harbor city with marble streets, lively tavernas and an impressive Venetian fort with 1,000 steps up or down depending on the cable car made our must-return list.

At Lavrion, with our guests safely on board, we ventured out of port believing that the winds would dissipate. Well! After 4 hours of battling the Meltemi with up to Force 9 gusts, we arrived at Kythnos and anchored next to the Apokriosis sandbar. We earned a relaxed dinner at the only taverna in sight. We had lamb and shrimp with a classic Greek salad. Talking with the local folks, we learned the location of natural hot springs and indulged the following morning...then headed to the capital city of Siros, Ermoupolis using the iron genny since the Meltemi was gone. A climb to Anos Syros to see a cathedral and narrow streets reflective of medieval times was rewarded with a great dinner at a backstreet taverna. The tzatziki and eggplant salad were delicious especially when served with warm pita (specially requested)...best ever! Purchased two local desserts one known as Chalvadopita and the other loukatia. Forging on to Delos, we were in awe of the impressive site steeped in mythology as the birthplace of Apollo and Artemis. Strict rules prevent anchorage after 3 p.m. so we headed to Mykonos and anchored in view of the famous windmills. Unlike most of the Cycladic islands, barren and devoid of vegetation with beautiful contrasts to an azure sea, Mykonos is more populated and moreover, every tourist’s destination!

As we began to relax, in came the outlook prediction of another Meltemi. This information forced a change in course. We chose Paros for two reasons; one, our friends secured passage back to Athens on a ferry from Paroika, and two, the wind encounters very high cliffs on the North shore of the island producing a calm extending for several miles offshore... or so we thought as I write this memo after two days in 24 to 28 knots of wind (with gusts to 40) at the dock. It is however a lovely spot with charming shops and known for providing the marble for Napoleon’s tomb. Today we head to town for provisioning and some shopping. Tomorrow, we plan but always on the lookout to hide from the Meltemi, which extends to Turkey, our final destination.”

Joseph Kemper was born and raised in Cox's Mills, WV. He enlisted in the Army in 1964 and was assigned to Aviation Mechanics. He served a tour in Vietnam very early in the war before there was much organization. He was sent into hostile areas several times to help recover downed aircraft in Vietnam and also assisted in military operations from the air. Originally, he had planned on becoming a pilot in the military but realized he would rather pursue that interest as a civilian. He would later become an airplane mechanic and licensed pilot in the U.S. He also accepted Christ into his life and spent 20 years in South America as a missionary pilot. Mr. Kemper has now returned to West Virginia to spend his retirement.

Il y a un article très intéressant dans le journal "De Morgen" du vendredi 18 avril 1986 (page 12) :

On y apprend que Jean-François Buslik et Frank Eaton se connaissaient, que Frank Eaton travaillait pour la CIA (autant que pour la DEA) et qu'il dirigeait de fait la lutte contre le trafic de drogue en Belgique, via le commandant François et la police judiciaire...

Il serait très intéressant de connaître le parcours complet de Frank Eaton. Selon l'ambassade des USA, il bénéficiait de l'immunité diplomatique ...

A partir du commandant François, on arrive à Guillaume Vogeleer et donc aux mercenaires, à "Soldier of Fortune" et à Stefano delle Chiaie...

Mr. Frank Eaton, 77 years old, was born in Kansas City, Missouri. He was adopted by loving parents and as a child traveled to France where his mother’s family lived. After the 11th grade, he moved to France where he assisted with the care of his grandfather and attended the National Conservatory of Music for four years.

Mr. Eaton returned to the United States and studied music at the Mannes School of Music in New York City. He then moved to California with his family and studied at California Western University and Colorado State. During summer breaks, he worked with the U.S. Forest Service fighting forest fires.

Mr. Eaton became a Deputy Sheriff in Sacramento, California after an Army tour. Then he received his Bachelor of Art degree and served as a Special Agent for the Drug Enforcement Administration (DEA). While at the DEA, Mr. Eaton was an agent stationed in Brussels, Belgium where his job required many undercover cases throughout Europe and the United States. His service as an undercover agent included cocaine busts totaling millions of dollars, interaction with global drug runners and other characters such as General Manuel Noriega.

Mr. Eaton ended his career with the DEA in San Diego where he served as a DEA Supervisor and received numerous awards. After retirement with the DEA, Mr. Eaton remained in San Diego where he was employed by the San Diego District Attorney’s (D.A.) Office as a Criminal Investigator in the Family Protection Unit. Mr. Eaton received Investigator of the Year from the D.A.’s office.

Mr. Frank Eaton is a resident of Heatherwood Retirement Community in Burke where he has resided since June 2010.
